Terms of Service

These terms are an agreement between your business and It’s Giving Pool (“we,” “us”) covering your use of our pool route management software and website. By creating an account or using the service, you agree to them.

The service

It’s Giving Pool provides route planning, dispatch, and service-record software for pool service companies. The service is offered for business use. We provide operational software — we do not guarantee route, weather, traffic, chemical, or billing outcomes, and your team remains responsible for the work it performs at each pool.

Accounts

You are responsible for keeping your account credentials secure, for the accuracy of the information you provide, and for activity that happens under your account — including access you grant to your technicians and team members. Tell us promptly at info@itsgivingpool.com if you believe your account has been compromised.

Acceptable use

Use the service only for lawful business operations. You agree not to misuse the service — including attempting to breach its security, interfering with its operation, accessing it by automated means outside the product’s intended use, reselling it without our written agreement, or entering data you do not have the right to store.

Plans, billing, and cancellation

Plans are month-to-month unless a written agreement says otherwise. There is no long-term contract: you can cancel at any time, effective at the end of the current billing period, and we do not charge cancellation fees. Stated founding or pilot rates are honored for the period we committed to. If prices change, we will give account owners advance notice before the change applies.

Your data

The client, pool, route, job, and service data you enter is yours, and it is exportable at any time. You grant us the limited rights needed to host, process, back up, display, and transmit that data to operate and improve the service. We do not sell it. Our handling of personal information is described in the Privacy Policy.

Our intellectual property

The service, including its software, design, and content we provide, belongs to It’s Giving Pool and is protected by law. These terms give you a right to use the service for your business while your subscription is active — they do not transfer any ownership in it.

Disclaimers

The service is provided “as is” and “as available.” While we work hard to keep it reliable, we do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose, and we disclaim all warranties to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, It’s Giving Pool will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Indemnification

You agree to defend and hold us harmless from claims arising out of your use of the service in violation of these terms or of applicable law, including claims relating to data you did not have the right to enter.

Termination

You can stop using the service and cancel at any time. We may suspend or terminate accounts that violate these terms or create risk for the service or other customers; where practical, we will give notice and an opportunity to export your data first.

Changes to these terms

We may update these terms as the product evolves. When we do, we will post the new version here and update the date at the top; material changes will be communicated to account owners. Continuing to use the service after a change takes effect means you accept the updated terms.

Governing law and general terms

These terms are governed by the laws of the State of Oklahoma and applicable United States federal law, without regard to conflict-of-law rules. If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with the Privacy Policy, are the entire agreement between us about the service.
